Dakta Green vs Police

New Zealand Police mounted a three day operation against The Daktory last Thursday, Friday,and Saturday. (31st December 2009, 1st and 2nd January 2010)

This involved Police parking up the street then following and stopping our members as they left The Daktory.

For some reason Police think they have the right to randomly stop and search people and vehicles for no other reason but they were departing The Daktory. “A known cannabis haunt”, according to Police.

Unfortunately for Police, their actions are illegal and a formal complaint is being prepared.

After suffering this nonsense for 2 days a plan was hatched should Police return for a third day. They did and the plan was implemented to perfection. The plan was simple. Dakta Green would drive away from The Daktory (his home and current court approved bail address) driving another members car with that member in the passenger seat and a cameraman filming from the rear seat he would circle the block and pull up back outside The Daktory. Would Police take the bait? They sure did.

Unlawful behavior by Police officers is never acceptable in a free and democratic society. Even if they are trying to catch ‘bad’ guys, Police must at all times comply with the law.

‘Tipping out’ cars and searching the occupants for no reason other than they have left The Daktory is illegal.

  1. Fishing falls way outside the POLICE operations manual. It is a sad indictment of current political thinking that catching bad dudes by whatever means ‘justifies the end’. The weekends Sunday Star Times item by Nicky Hager on the extended powers of the Police to surveil all and every email, txt, phone and fax will have consequences. It empowers this intimidating shite, as polite as these two officers were (thanks IMHO largely to the presence of the video camera). Whoever authorised the three day DAKTORY stakeout should LOOSE THEIR JOB for failing to correctly train officers in appropriate protocols. No New Zealander has authorised warrant-less random stopping, searching (tipping out, what a disgraceful terminology) and haranguing absent ANY proof of impairment or crime.

    Were a ‘list’ of members available either written or otherwise, these fellows have clearly indicated an interest in obtaining one. Under these FBI lobbied for surveillance laws that would make a STASI operative proud, ANY movement of a list, or contiguous emails could be USED by POLICE for purposes of ‘fishing’. And they do not have to tell you, it’s masked by ‘it is a random stop Sir’.

    Freedom of association is under grave threat. The “chilling” of dissent is anti-democratic and should be subject to much gnashing of teeth by the forth estate and academia. I don’t expect we will see it however…

    Good on DG for being cool and informing these fellows ‘that a complaint’ will be laid.

    I will be watching with interest.

    (should the POLICE be reading this… and by all accounts they are now empowered to not only do so, but also archive it, choke on this; “PIGGISH” no longer adequatly describes your roadside manner, no matter how polite you pretend to be.)

    i live in the US.. cops hate pot here! they are so aggressive about it that its scary. your country is a wonder that establishments like this one even exist (in America, outside of Denver and California, Americans who don’t smoke fear pot). I love how this was handled, and I hope you don’t have your streets so polluted from now on

    Misinformed??? theyre informed alright, theyre stand over merchants that plan,scheme,forge documents,create terror in family homes,then they divide the takings,send alil to the crown saying thats all there was,and take there plundered and pilaged prizes home,believe me,it happened..to me

    Great piece of footage DG, it’s interesting to see how police are handling this. Saddening really – all this police time being essentially wasted when there’s actual crime to fight.

    Random stopping IS legal. Targeted stopping is NOT.

    Police have the power to stop and search for drugs where they have reasonable grounds to so suspect there being drugs specified in the Misuse of Drugs schedule being in the vehicle (they are authorised to make stops for this purpose).

    Currently cultivating, smoking and selling cannabis is a CRIME. The Police exercise a level of discretion with respect to pot smokers (look at how long the Daktory has been allowed to continue). However, at some point this open flouting of the rule of law must be kerbed.

    Good on the Police. All you fuckwits going on about ‘STASI’ tactics and the Police pillaging homes to remit the proceeds to the Crown are delusional – lay off the pot.
